1. Acceptance

By using kingdom52.com, you agree to these terms. If you don't agree, don't use the site.

2. What this site is, and isn't

This site describes Kingdom52 LLC's services, pricing, and how to reach us. Nothing on this site is an offer that becomes binding just by browsing it or booking a call. An actual engagement begins only when both parties sign a Statement of Work and, where applicable, a Master Services Agreement. Where this site and a signed agreement conflict, the signed agreement controls.

3. No professional advice

Kingdom52 is not a law firm, accounting firm, or investment advisor. Nothing on this site, or in any consultation, is legal, tax, or investment advice. Where those needs come up, we refer clients to our attorney, CPA, and financial advisor network; use of that network is between the client and that professional, not Kingdom52.

4. Intellectual property

The content, design, and branding of this website belong to Kingdom52 LLC, except where noted otherwise. You may view and share it for its intended purpose, evaluating our services, but not reproduce it for another business's use.

Work Kingdom52 does for a client is governed by that client's signed agreement. Under that agreement, the client's own data and content remain the client's property at all times. Kingdom52 does not use client data for any purpose outside the engagement and will return or delete it on request or when the engagement ends, except as needed to comply with law or for our own legal recordkeeping.

Kingdom52 keeps sole ownership of its software, platform, source code, hosting environments, and configurations, and of its pre-existing tools, templates, and frameworks. These are not transferred to the client. Any of those tools, templates, or frameworks built into a client's own website files come with a lasting license to keep using them as part of that site, including after the client leaves. Once a client has paid in full, it receives a non-exclusive, royalty-free license to use what we built for its own operations. Continued access to Kingdom52's hosted systems requires the client to stay active and paid on the plan or license in its signed agreement.

A client may leave on the notice its signed agreement requires. Plans, CRM only, the Learning Platform and Hosting Only are billed month to month or yearly in advance. A yearly payment is 11 times the monthly price (one month free), and the one-time setup fee is waived; website build fees are not part of this offer. A client may cancel at any time with one month's written notice. Yearly payments are not refunded. Help and changes beyond a plan's included hours, and all help on a plan with no included hours, are billed at $65 an hour with a one-hour minimum. Hosting Only is for a website with no CRM or Learning Platform. When a client leaves, Kingdom52 delivers, at no charge, the client's website files and its own data and content, as a database export and CSV files, and does not hold that export back over amounts owed. The export does not include Kingdom52's CRM or Learning Platform software, source code, or database structure. We switch off the connection to our systems at handover, and any help beyond the export is billed at $65 an hour with a one-hour minimum. Login access to our systems ends at that time, and the client may keep using the exported files on hosting of its own choosing.

A client's payment processing account is set up, owned, and controlled by the client in its own name. Card details are entered directly with a secure third-party payment processor and stay with that processor. Kingdom52 does not store card numbers.

If anything in this section conflicts with a client's signed agreement, the signed agreement controls.

5. Support

Kingdom52 replies to support requests within 48 business hours on Website + CRM, CRM only, the Learning Platform on its own and Hosting Only; within 24 business hours on Growth; and within 24 business hours on Partner and the Operations Retainer, with priority: same business day for anything broken. On every plan, if your site, giving form, checkout or forms are down, we respond the same business day. Business hours are Mon–Fri, 8am–5pm Central, excluding US federal holidays, and only those hours count toward a response time. Requests received after 3pm Central, on weekends or on US federal holidays are treated as received the next business day. If you have more than one plan with us, the fastest response time applies.

These are response times, not fix times. We work on the issue until it is resolved but do not guarantee how long a fix will take. If we miss a response time, tell us and we will make it right; repeated misses let you cancel under these terms. A missed response time is not otherwise a breach and does not create a refund or credit.

6. Disclaimers and limitation of liability

This site and its content are provided as is. We work to keep pricing and scope information current, but figures on this site are for planning purposes and are not a binding quote until confirmed in a signed agreement. To the extent allowed by law, Kingdom52 is not liable for damages arising from your use of this website; liability for an actual engagement is governed by that engagement's signed agreement.

7. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

8. Changes

We may update these terms as the business changes. We'll update the effective date above when we do.
